CHILD SUPPORT H.B. 5633 (H-2): FLOOR ANALYSIS
House Bill 5633 (Substitute H-2 as reported with amendment) Sponsor: Representative Robert DeMars
House Committee: Judiciary and Civil Rights
Senate Committee: Families, Mental Health and Human Services
The bill would amend Chapter 84 of the Revised Statutes of 1846, entitled “Of divorce”, to delete provisions that allow the court to order child support in an amount determined by the child support formula or an amount that deviates from the formula under specified circumstances; require a parent to inform the Friend of the Court of his or her sources of income and available health care coverage; and require parents to maintain health care coverage for their children. In addition, the bill would require that any conflicts between the provisions contained in the Support and Parenting Time Enforcement Act and Chapter 84 concerning the contents or enforcement of a support order be controlled by Chapter 84.
The bill is tie-barred to House Bill 5634, which would amend the Support and Parenting Time Act to consolidate into that Act provisions deleted by House Bills 5629-5633, and to House Bill 5636. House Bill 5636 (S-4) would provide for parenting plans in child custody cases and create a presumption of shared parental responsibility.
