YORK TOWNSHIP CONVEYANCE H.B. 5343: FLOOR ANALYSIS

The bill would permit the State Administrative Board, on behalf of the State, to convey to York Township, in Washtenaw County, for $1 property currently under the jurisdiction of the Department of Mental Health. The conveyance would have to provide that the property conveyed would have to be used for providing an entrance and parking area for a public park located next to the property conveyed; that the park entrance and parking area would have to be open to all State residents on the same terms, fees, and conditions; and that, upon termination of that use, or upon use for any other purpose, title to the property could revert immediately to the State, which would assume no liability for any improvements made by York Township.
The conveyance would have to be by quitclaim deed approved by the Attorney General, and would have to reserve to the State all rights to oil, coal, gas, or other materials, excluding sand, gravel, clay, or other nonmetallic minerals found on, within, or under the conveyed land.
The revenue from the conveyance would have to be deposited in the State Treasury and credited to the General Fund.

To the degree that the property is currently held but unused for a public purpose and would be conveyed to a local unit for a public purpose, there would be no financial impact on the State except in terms of potential revenue otherwise associated with a fair market value sale of the property.
