CONTENT

 

The bill would amend the Support and Visitation Enforcement Act to replace references to a “fee” on past due support payments with references to a “surcharge”. Currently, a fee calculated at an 8% annual rate must be added to support payments that are past due as of January 1 and July 1 of each year. The bill also provides that the amount shown as due and owing on the Friend of the Court records as of January 1 and July 1 of each year would have to be reduced by an amount equal to two weeks of support for purposes of assessing the surcharge. In addition, the bill specifies that a support order would not accrue interest.

 

The bill would take effect on January 1, 1996, and would apply to an arrearage that was due, or that became due, on and after the effective date.
