Senate Bill 756 (Substitute S-1 as reported) Sponsor: Senator Michael J. Bouchard

Committee: Natural Resources and Environmental Affairs

CONTENT

The bill would amend the Natural Resources and Environmental Protection Act to delete a December 15, 1995, sunset on provisions that prohibit the Department of Natural Resources (DNR) from issuing a permit for a municipal solid waste incinerator unless it is located at least 1,000 feet from any residential building, public or private elementary or secondary school, preschool facility for infants or children, hospital, and nursing home. This prohibition does not apply, however, to a municipal solid waste incinerator that existed prior to June 15, 1993, or to the modification, alteration, expansion, or retrofit of an incinerator after that date. The bill also would delete the requirement that the DNR, by December 15, 1995, promulgate rules pertaining to municipal solid waste siting setbacks from structures.
