MISCELLANEOUS PROVISIONS


556.501 Uniformity of application and construction.

Sec. 401.

    In applying and construing this act, consideration should be given to the need to promote uniformity of the law with respect to the act's subject matter among the states that enact the uniform act on which this act is based.

556.502 Relation to electronic signatures in global and national commerce act.

Sec. 402.

    This act modifies, limits, and supersedes the federal electronic signatures in global and national commerce act, 15 USC 7001 to 7006, but does not modify, limit, or supersede section 101(c) of that act, 15 USC 7001, or authorize electronic delivery of any of the notices described in section 103(b) of that act, 15 USC 7003.

556.503 Effect on existing powers of attorney.

Sec. 403.

    Except as otherwise provided in this act, on the effective date of this act all of the following apply:
    (a) Except as provided in subdivision (c), this act applies to a power of attorney created before, on, or after the effective date of this act.
    (b) This act applies to a judicial proceeding concerning a power of attorney commenced on or after the effective date of this act.
    (c) This act applies to a judicial proceeding concerning a power of attorney commenced before the effective date of this act unless the court finds that application of a provision of this act would substantially interfere with the effective conduct of the judicial proceeding or prejudice the rights of a party, in which case that provision does not apply and the superseded law applies.
    (d) An act done before the effective date of this act is not affected by this act.

556.504 Repeal of MCL 700.5501-700.5505.

Sec. 404.

    Sections 5501 to 5505 of the estates and protected individuals code, 1998 PA 386, MCL 700.5501 to 700.5505, are repealed.

556.505 Effective date.

Sec. 405.

    This act takes effect July 1, 2024.
