CONTENT

 

The bill would amend the Michigan Law Enforcement Officers Memorial Act to modify the duties of the Michigan Law Enforcement Officers Memorial Monument Fund Commission.

 

Under the Act, the Commission is the governing body of the Monument Fund. The Commission must do both of the following:

 

 --    Oversee the financing, design, and construction of a memorial monument dedicated to law enforcement officers and reserve law enforcement officers from Michigan who died in the line of duty and individuals from Michigan who qualify as an officer who died in the line of duty for purposes of inclusion on the National Law Enforcement Officers Memorial.

 --    Solicit designs for the monument and select the final design.

 

The bill also would require the Commission to maintain and upkeep the memorial monument, subject to appropriation.

 

In addition, the bill would repeal Section 7 of the Act, which dissolves the Commission after monument construction has been completed and requires any balance remaining in the Monument Fund to be used to maintain the monument.

FISCAL IMPACT

 

The bill would have no significant fiscal impact on State or local government. The Commission is funded through donations and grants from the Federal government as well as nongovernmental organizations and private individuals. However, the Department of Technology, Management, and Budget (DTMB) is permitted to receive and spend funds from the Commission to be spent on maintenance and upkeep of the monument. The DTMB reported that it spent about $27,000 from the Michigan Law Enforcement Officers Memorial Fund in fiscal year 2020-21 for this purpose. The bill would make the Commission's responsibility for maintenance and upkeep subject to appropriation; however, it would not make any appropriation for this purpose.
