ENROLLED SENATE BILL No. 1042
AN ACT to amend 1984 PA 427, entitled An act to provide for a retirement system for municipal and judicial employees; to create a retirement board and to prescribe its powers and duties; to prescribe the powers and duties of certain other state officers and agencies; and to repeal certain acts and parts of acts, (MCL 38.1501 to 38.1555) by adding section 45b.
The People of the State of Michigan enact:
Sec. 45b. The retirement board shall provide for a hearing on written request of a person, participating court, or participating municipality aggrieved by a decision of the retirement system. The hearing under this section must be conducted as a contested case under chapter 4 of the administrative procedures act of 1969, 1969 PA 306, MCL 24.271 to 24.288, and policies or procedures adopted by the retirement board, and a final order of a hearing under this section is subject to chapter 6 of the administrative procedures act of 1969, 1969 PA 306, MCL 24.301 to 24.306.
Enacting section 1. This amendatory act is intended to be retroactive and applies retroactively effective after August 14, 1996.
Enacting section 2. This amendatory act does not take effect unless Senate Bill No. 1041 of the 101st Legislature is enacted into law.
