CONTENT Michigan Natural Resources Trust Fund. On December 7, 2011, the Michigan Natural Resources Trust Fund (MNRTF) board adopted FY 2011-12 recommendations for acquisition and development projects pursuant to Article IX, Section 35 of the Michigan Constitution and the Natural Resources and Environmental Protection Act. The recommendations include a $39,665,200 appropriation from the MNRTF for 22 acquisition projects and 77 development projects. Matching funds of $27,243,700 result in total project costs of $66,908,900. An appropriation bill is necessary to authorize the spending recommended by the MNRTF board. The attached information provides details on projects recommended, including a description of the project, location, and cost.


The MNRTF consists of all bonuses, rentals, delayed rentals, and royalties collected or reserved by the State under provisions of leases for the extraction of nonrenewable resources from State-owned land, except such revenue accruing under leases of State-owned land acquired with money from the State or Federal Game and Fish Protection Fund or revenue accruing from land purchased with such revenue. Until the corpus of the MNRTF reached $500 million, annual expenditures consisted of MNRTF interest and earnings, and 33?% of MNRTF revenue received by the State during the previous fiscal year. Revenue from leases in FY 2009-10 and the use of the stabilization reserve resulted in a substantial increase in funds available for projects in FY 2010-11. The MNRTF reached $500 million in 2011, which will limit future expenditures to annual interest earnings.
Department of Natural Resources Supplemental. The Department of Natural Resources (DNR) received approval from the U.S. Fish and Wildlife Service to use $4.0 million in Federal Dingell-Johnson funds for the operation and maintenance of boating access sites for FY 2011-12. Since these Federal funds come with an expiration date of five years, the DNR seeks to use them for operations rather than the two capital outlay projects listed in the bill. The reasoning behind this decision is that operational funds are all but guaranteed to be used during the fiscal year, while funds for capital outlay projects quite often are disbursed over a period of fiscal years as progress on the projects moves forward. Money from the State Waterways Fund, however, belongs to the State of Michigan, and there is no risk of those funds expiring. These adjustments will result in the availability of $1,783,100 in State Waterways funding for State projects.

Boilerplate

Section 301 provides criteria for agreements with local units of government for administration of MNRTF grants.


Section 302 provides for work project status of grants. At completion or after three fiscal years, unspent balances lapse to the MNRTF.




FISCAL IMPACT


The Michigan Natural Resources Trust Fund appropriation includes a $39,665,200 appropriation from the MNRTF for 22 acquisition projects and 77 development projects. Matching funds of $27,243,700 result in total project costs of $66,908,900.


The Department of Natural Resources supplemental shifts funding from the Michigan State Waterways Fund to available Federal revenue to maximize use of available Federal revenue and preserve the availability of State restricted funds.
