House Bill 5363 (Substitute H-1 as passed by the House)

Sponsor:  Representative Charles M. Brunner

House Committee:  Agriculture

Senate Committee:  Agriculture

Date Completed:  12-5-12

CONTENT

The bill would amend Part 115 (Solid Waste Management) of the Natural Resources and Environmental Protection Act to exclude soil from sugar beet production from the definition of "solid waste", under certain circumstances.

Specifically, soil that was washed or otherwise removed from sugar beets, was not more than 35% moisture content, and was registered as a soil amendment under Part 85 (Fertilizers) of the Act would be included in the list of materials that are not considered solid waste under Part 115.  The bill specifies that any testing required to become registered under Part 85 would be the responsibility of the generator.

(Part 115 defines "solid waste" as garbage, rubbish, ashes, incinerator ash, incinerator residue, street cleanings, municipal and industrial sludge, solid commercial and solid industrial waste, and animal waste other than organic waste generated in the production of livestock and poultry.)
