CONTENT

 

The bill would amend the Michigan Employment Security Act to specify that a person who testified voluntarily before another body concerning representations he or she made to the Unemployment Insurance Agency pursuant to the administration of the Act would waive any privilege under Section 11 of the Act that otherwise would apply to his or her representations to the Agency.

 

(Under Section 11, with specific exceptions, information obtained from any employing unit or individual related to the administration of the Act and determinations as to the benefit rights of any person are confidential and may not be disclosed or open to public inspection other than to public employees or officials, or contractors of those officials, in the performance of their official duties under the Act.  In addition, any written or verbal report or statement made by any person to the Agency or any person engaged in administering the Act is a privileged communication.  A person, firm, or corporation may not be held liable for slander or libel on account of a report or statement.  The records and reports in the Agency's custody must be available for examination by the employer or employee affected.)
