CONTENT
The bill would amend Part 115 of the Natural Resources and Environmental Protection Act by removing the October 1, 2011, sunset on the solid waste surcharge fees that are paid by landfill operators on a per-cubic-yard basis. Additionally, the bill would increase these fees from 7 cents per cubic yard to 12 cents starting October 1, 2011, 13 cents starting October 1, 2012, 14 cents starting October 1, 2013, and 15 cents from October 1, 2014, through September 30, 2015.

FISCAL IMPACT
The FY 2011-12 DEQ budget was built on the assumption that this fee would be raised by the amounts contained in the bill. Currently, the solid waste surcharge fees raise approximately $2.8 million per year. These fees are used as the primary funding source for the regulation, inspection and monitoring of private and public solid waste landfills in the State. The Department of Environmental Quality estimates that under the bill, approximately $4.6 million would be raised in FY 2011-12, $4.68 million in FY 2012-13, $4.76 million in FY 2013-14, and $4.8 million in FY 2014-15.
