CONTENT

The bill would amend Section 321 of the Revised Judicature Act to eliminate the scheduled reduction of certain motion fees paid to the Court of Appeals.


Under current law, motions for immediate consideration and motions to expedite appeal are subject to a $200 motion fee. All other motions are subject to a $100 motion fee. Beginning on October 1, 2012, these fees will be reduced to $150 and $75, respectively. House Bill 4731 would eliminate this reduction in Court of Appeals motion fees and maintain the current fee schedule.

FISCAL IMPACT

A review of recent annual Court of Appeals motion fee collections indicates that the fees generate annual revenue of approximately $300,000. Because the forthcoming sunset on current motion fees equates to a 25% reduction in those fees, it is anticipated that the bill would avert a loss of restricted revenue of about $75,000 in FY 2012-13.
