MUSIC PERFORMANCE ADVISORIES - S.B. 239 (S-3): FLOOR ANALYSIS

CONTENT


The bill would create a new act to provide that tickets and advertisements for a musical performance could contain a specified parental advisory, if the performer's most recent recorded music contained a parental advisory label issued by the recording industry as to the explicit content of the recorded music. The bill also would do the following:


-- Exempt from the advisory provisions the performance of a performer who was appearing with another performer, but whose appearance had not been advertised or promoted.

-- Require the Department of State to maintain a list of music venues in the State that complied with the bill, which would be available to the public; remove a music venue that was not in compliance; and, permit a venue to petition to be placed back on the list one year after being removed.


The bill specifies that it would take effect 60 days after enactment.

FISCAL IMPACT


The Department of State would incur administrative costs to compile and maintain the list prescribed in the bill. The fiscal impact on the State is indeterminate. There would be no fiscal impact on local government.
