Motions and Resolutions

Rep. Dianda offered the following resolution:

House Resolution No. 154.

A resolution to declare June 17-23, 2013, as Finnish-American Heritage Week in the state of Michigan.

Whereas, On Midsummer’s Eve 1865, some 30 Finns and Sámi landed on the shores of the Portage Canal in Hancock, Michigan, and began work in the copper mines the next day; and

Whereas, Their immigration formed a unique Finnish American culture that reflects their roots and their continued ties to Finns worldwide and across Michigan; and

Whereas, Finnish American cuisine, from mojakka, a traditional stew, to leipäjuusto or “squeaky cheese,” and sweet baked goods are still an important part of their rich culture; and

Whereas, The Finnish love for saunas has gone unchanged and saunas remain the place to go during the blistering cold winters of the Upper Peninsula; and

Whereas, Their pride in that ancestry is evident in a variety of ways - from bilingual street signs to Finnish flags on cars and light poles to the sounds of the Finnish language being spoken each day in local restaurants and coffee shops; and

Whereas, Finns’ strong work ethic in the mines made Michigan the world’s largest provider of copper for decades; and

Whereas, The 1913 Strike, during which many Finns fought for their rights as workers, was a momentous event in United States and Michigan labor history; and

Whereas, Michigan’s Copper Country is recognized as the focal point of Finnish immigration to America; and

Whereas, Michigan is home to the nation’s highest density of Finnish-Americans and more than 30 percent of the Copper Country’s residents can claim Finnish ancestry; and

Whereas, Michigan’s Copper Country remains a pivotal center of Finnish-American culture and is host to the most significant Finnish ethnic enclave outside of Finland; and

Whereas, Suomi College, now Finlandia University, in Hancock, Michigan, is the only institution of higher education founded by Finns in the United States; and

Whereas, Michigan boasts the Finnish American Historical Archives and it is the largest archival collection of Finnish American materials in the world; and

Whereas, Hancock, Michigan, has been honored this year by hosting FinnFest USA 2013, an international event that draws visitors from around the world to celebrate Finnish culture, for the third time; now, therefore, be it

Resolved by the House of Representatives, That the members of this legislative body declare June 17-23, 2013, as Finnish-American Heritage Week in the state of Michigan; and be it further

Resolved, That copies of this resolution be transmitted to the City of Hancock, the County of Houghton, Finlandia University and the FinnFest USA 2013 Organizing Committee.

The question being on the adoption of the resolution,

Senate Bill No. 51, entitled

A bill to amend 1893 PA 206, entitled “The general property tax act,” by amending section 7jj (MCL 211.7jj[1]), as added by 2006 PA 378.

The motion prevailed and the substitute (H-1) was adopted, a majority of the members serving voting therefor.

Rep. Barnett moved to amend the bill as follows:

1. Amend page 18, line 16, after “effect” by striking out the balance of the sentence and inserting “upon the expiration of 90 days from the end of the session at which it was passed.”.

The motion did not prevail and the amendment was not adopted, a majority of the members serving not voting therefor.

Rep. Dillon moved to amend the bill as follows:

1. Amend page 18, following line 17, by inserting:

“Enacting section 2. The legislature shall annually appropriate sufficient funds from the state general fund to the state school aid fund created in section 11 of article IX of the state constitution of 1963 to fully compensate for any loss of revenue to the state school aid fund resulting from the enactment of this amendatory act.”.

The motion did not prevail and the amendment was not adopted, a majority of the members serving not voting therefor.

It is my fear that by mixing Off-Road Vehicles with normal traffic, that we are increasing the risk of injury or death. I am also concerned with the damage made to the shoulder of the road by the Off-Road Vehicles, where proper grading and drainage will be harmed. For these reasons, I voted no on HB4284 and HB4299.”

A bill to amend 2011 PA 142, entitled “Health insurance claims assessment act,” (MCL 550.1731 to 550.1741) by amending enacting section 2.

1. Amend page 1, following “THE PEOPLE OF THE STATE OF MICHIGAN ENACT:” by inserting:

“Sec. 3. (1) For dates of service beginning on or after January 1, 2012, subject to THIS SUBSECTION AND subsections (2), (3), and (4), there is levied upon and there shall be collected from every carrier and third party administrator an assessment of 1% on that carrier’s or third party administrator’s paid claims. BEGINNING JANUARY 1, 2014, THE DEPARTMENT SHALL ANNUALLY REDUCE THE ASSESSMENT RATE UNDER THIS SUBSECTION BY 0.2%.

(2) A carrier with a suspension or exemption under section 3717 of the insurance code of 1956, 1956 PA 218, MCL 500.3717, on the effective date of this act SEPTEMBER 20, 2011 is subject to an assessment of 0.1%.

(3) All of the following apply to a group health plan that uses the services of a third party administrator or excess loss or stop loss insurer:

(a) A group health plan sponsor shall IS not be responsible for an assessment under this subsection for a paid claim where IF the assessment on that claim has been paid by a third party administrator or excess loss or stop loss insurer, except as otherwise provided in section 3a(2).

(b) Except as otherwise provided in subdivision (d), the third party administrator shall be IS responsible for all assessments on paid claims paid by the third party administrator.

(c) Except as otherwise provided in subdivision (d), the excess loss or stop loss insurer shall be IS responsible for all assessments on paid claims paid by the excess loss or stop loss insurer.

(d) If there is both a third party administrator and an excess loss or stop loss insurer servicing the group health plan, the third party administrator shall be IS responsible for all assessments for paid claims that are not reimbursed by the excess loss or stop loss insurer and the excess loss or stop loss insurer shall be IS responsible for all assessments for paid claims that are reimbursable to the excess loss or stop loss insurer.

(4) The assessment under this section shall not exceed $10,000.00 per insured individual or covered life annually.

(5) To the extent an assessment paid under this section for paid claims for a group plan or individual subscriber is inaccurate due to subsequent claim adjustments or recoveries, subsequent filings shall be adjusted to accurately reflect the correct assessment based on actual claims paid.

(6) If the assessment under this section collects revenue in an amount greater than $400,000,000.00, adjusted annually by the medical inflation rate, each carrier and third party administrator that paid the assessment shall receive a proportional credit against the carrier’s or third party administrator’s assessment in the immediately succeeding year. The department shall send a notice of credit to each carrier or third party administrator entitled to a credit under this subsection not later than July 1. A carrier or third party administrator entitled to a credit under this subsection shall apply that credit to the July 30 payment. Any unused credit shall be carried forward and applied to subsequent payments. If a carrier or third party administrator entitled to a credit under this subsection has no liability under this act in the immediately succeeding year or if this act is no longer in effect, the department shall issue that carrier or third party administrator a refund in the amount of any unused credit. If a third party administrator receives a credit or refund under this subsection, the third party administrator shall apply that credit or refund to the benefit of the entity for which it processed the claims under a service contract.”.
