“Heavenly Father, we come to You today expressing thanks for the many blessings You have bestowed upon those of us who are fortunate enough to live in this great state of Michigan. May we always be mindful of what a special treasure we have with our Great Lakes and unique peninsulas. Lord, we pray, that with Your guidance and Your will that this chamber will always be filled with wisdom and compassion and free of self interest. Amen.”

Motions and Resolutions

Rep. Opsommer offered the following resolution:

House Resolution No. 6.

A resolution to memorialize the Congress of the United States to ensure that any new economic stimulus package includes a stimulus for individual taxpayers and targeted tax cuts for Americans, including incentives for past and current homeowners.

Whereas, Congress is presently considering an economic stimulus package as a means to combat the recession. Many of the steps already taken or proposed have focused on banks, large corporations, and the states themselves. Tax breaks and other stimulus strategies for individual people and families deserve more attention in these discussions; and

Whereas, As the U.S. economy continues to falter and the housing crisis at the root of the slowdown continues to persist, more and more Americans face the prospect of losing their homes. It is estimated that almost a full quarter of all homes for sale in the United States will have been foreclosed upon and owned by banks. In Michigan, roughly one in 400 homes has received a foreclosure filing; and

Whereas, In these hard economic times, many people are being forced to take money out of their 401(k), 403(b), or similar qualified retirement or educational funds in order to keep their homes. In addition to the sacrifices to their future, these men and women are hit with an extra 10 percent tax penalty for early withdrawals. This has been going on for many years, yet the IRS has not changed policy to reflect changing times and new economic realities; and

Whereas, High energy costs are another reason people are finding it difficult to stay in their homes. The economic stimulus proposal should provide low-income energy assistance for individual homeowners who take steps to make their homes more energy efficient. With skyrocketing energy costs, steps must be taken to mitigate the burden on individuals and families as part of any economic stimulus package; and

Whereas, Legislation enacted as part of any economic stimulus package should provide assistance and tax cuts directly to individuals, and should include targeted strategies for homeowners regarding property taxes, energy costs, and those who have had to divert retirement and education funds in order to make ends meet. Moreover, these penalty-free withdrawal provisions should be made retroactive back to the 2005 tax year to provide fairness and flexibility to families who at different times have been forced to make extraordinary financial decisions as part of their efforts to stay in their homes; now, therefore, be it

Resolved by the House of Representatives, That we memorialize the Congress of the United States to ensure that any new economic stimulus package includes a stimulus for individual taxpayers and targeted tax cuts for Americans, including incentives for past and current homeowners, retroactive over the course of the past five years; and be it further

Resolved, That copies of this resolution be transmitted to the President of the United States Senate, the Speaker of the United States House of Representatives, and the members of the Michigan congressional delegation.

House Concurrent Resolution No. 3.

A concurrent resolution to request the State Officers’ Compensation Commission to recommend a 5 percent reduction in salaries of the members of the Legislature, the Governor, the Lieutenant Governor, the Attorney General, and the Secretary of State the next time the commission meets and to urge the commission to ensure that none of its future recommendations exceed the average increase in state employee pay.

Whereas, Our state’s continuing economic struggles emphasize the need to make sacrifices for our future economic and fiscal health. All avenues to encourage that fiscal policies and decisions reflect this need for prudence must be pursued; and

Whereas, Article IV, Section 12 of the State Constitution of 1963 provides for the State Officers’ Compensation Commission. This commission determines the salaries and expense allowances of certain elected state officers, including the members of the Legislature, the Governor, the Lieutenant Governor, the Attorney General, and the Secretary of State. Pursuant to state statutes amended to conform to 2002 changes in the constitutional provisions regarding the commission, the State Officers’ Compensation Commission will next meet in 2009; and

Whereas, It is important for all possible mechanisms to be put in place to avoid unnecessary spending. Reducing the salaries of the state’s highest elected officers and restraining spending increases can help safeguard the public’s interests at an important time in our state’s history. Establishing a ceiling for the recommendations that the State Officers’ Compensation Commission can make, by making sure future recommendations cannot exceed the average increase in state employee pay, is an appropriate and long-overdue step to take. These moves can enable other reforms in policy to take root; now, therefore, be it

House Concurrent Resolution No. 4.

A concurrent resolution to affirm Michigan’s sovereignty under the Tenth Amendment to the Constitution of the United States and to urge the federal government to halt its practice of imposing mandates upon the states for purposes not enumerated by the Constitution of the United States.

Whereas, The Tenth Amendment to the Constitution of the United States reads as follows: “The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people”; and

Whereas, The Tenth Amendment defines the total scope of federal power as being that specifically granted by the Constitution of the United States and no more; and

Whereas, The scope of power defined by the Tenth Amendment means that the federal government was created by the states specifically to be an agent of the states; and

Whereas, Today, in 2009, the states are demonstrably treated as agents of the federal government; and

Whereas, Many federal mandates are directly in violation of the Tenth Amendment to the Constitution of the United States; and

Whereas, The United States Supreme Court has ruled in New York v. United States, 112 S. Ct. 2408 (1992), that Congress may not simply commandeer the legislative and regulatory processes of the states; and

Whereas, A number of proposals from previous administrations and some now pending from the present administration and from Congress may further violate the Constitution of the United States; now, therefore, be it

Resolved by the House of Representatives (the Senate concurring), That we hereby affirm Michigan’s sovereignty under the Tenth Amendment to the Constitution of the United States over all powers not otherwise enumerated and granted to the federal government by the Constitution of the United States. We also urge the federal government to halt its practice of imposing mandates upon the states for purposes not enumerated by the Constitution of the United States; and be it further

Resolved, That copies of this resolution be transmitted to the Office of the President of the United States, the President of the United States Senate, the Speaker of the United States House of Representatives, and the members of the Michigan congressional delegation.

Rep. Opsommer offered the following concurrent resolution:

House Concurrent Resolution No. 5.

A concurrent resolution to request the State Officers Compensation Commission to recommend a 10 percent legislative salary reduction and to endorse and follow certain performance-based pay structures.

Whereas, Article IV, Section 12 of the state constitution of 1963 established the State Officers Compensation Commission (SOCC). The SOCC was established to determine the salaries and expense allowances of the members of the Legislature, the Governor, the Lieutenant Governor, the Attorney General, the Secretary of State, and the Justices of the Supreme Court. Section 3 of 1968 PA 357, as amended, provides that the commission shall meet for not more than 15 session days beginning after January 31 of every odd-numbered year. Section 6 of the act provides that the SOCC must file its recommendations on or before June 15 of each odd-numbered year; and

Whereas, In light of the need to make structural reforms to Michigan’s budget, we believe that, as elected leaders in state government, we have an obligation to restructure our pay rates. We request the State Officers Compensation Commission to recommend a 10 percent reduction in the salaries of the members of the Legislature when the commission meets in 2009; and

Whereas, We also request that in the course of all future meetings that the SOCC limit any proposed increases to either the rate of inflation, or the average pay rate increase of other state of Michigan employees, whichever is lower; and

Whereas, We also request the commission to endorse and follow any constitutional changes that would create a performance-based pay structure that provides for a pro-rata pay reduction for any days the legislative body is in session and a legislator does not attend session, except in the case of excused personal illness or the serious illness or death of a family member, with the monies transferred to the General Fund; and

Whereas, We also request the commission to endorse and follow any constitutional changes that would create a performance-based pay structure that provides that for any days past Labor Day for which an individual chamber has not passed from that chamber all bills necessary to provide for a balanced budget for the fiscal year that begins that October 1, all legislators of that chamber (or both chambers if neither has passed bills to balance the budget) shall have their salaries reduced on a pro-rata basis. The money not paid in salary for those days shall be transferred to the General Fund; now, therefore, be it

Resolved by the House of Representatives (the Senate concurring), That we request the State Officers Compensation Commission to recommend a 10 percent reduction in the salaries of the members of the Legislature following its 2009 deliberations and to endorse and follow the performance-based pay structures as outlined in this resolution and enacted into law; and be it further

Resolved, That copies of this resolution be transmitted to members of the State Officers Compensation Commission, the Director of the Michigan Department of Management and Budget, and the State Personnel Director.

Rep. Opsommer offered the following concurrent resolution:

House Concurrent Resolution No. 6.

A concurrent resolution to memorialize the President, the Congress, and the Department of Homeland Security of the United States to change requirements, agreements, and memorandums of understanding relating to the creation of Enhanced Drivers Licenses.

Whereas, The Department of Homeland Security is currently requiring that any state that wishes to create an Enhanced Drivers License (EDL) as a result of passage of the federal Western Hemisphere Travel Initiative (WHTI) must create an EDL that incorporates what the federal government refers to as “facilitative technology.” This ambiguous term has been defined in practice to mean the incorporation of unencrypted, long-range, radio-wave computer chip technology that allows for a unique citizen identification number that can be passively read through wallets, purses, doors, and cars without the owner’s knowledge; and

Whereas, After Michigan made several attempts to create an EDL that would not need this technology, it became clear that the Department of Homeland Security would only allow Michigan the option to voluntarily abandon the entire EDL program, jeopardizing the state’s economy. The WHTI’s only true mandate was that Americans needed to prove their citizenship in order to reenter into the United States. Facilitative technology was never required by Congress, places technology contracts over security, and is an example of departmental overreach and encroachment onto states’ rights; and

Whereas, The driver license information of Michigan citizens would be shared with the governments of Canada and Mexico via the Security and Prosperity Partnership (SPP) and EDL agreements. However, how it would be shared is ambiguous and needs to be defined so that we can ensure that potential corruption in foreign bureaucracies does not result in identity theft or other security concerns for U.S. citizens. There is currently little congressional oversight of the SPP, again placing a single department’s bureaucracy largely in charge of rules and regulations that significantly impact the states and their citizens; now, therefore, be it

Resolved by the House of Representatives (the Senate concurring), That we memorialize the President, the Congress, and the Department of Homeland Security of the United States to change requirements, agreements, and memorandums of understanding relating to the creation of Enhanced Drivers Licenses to help address these concerns. We formally call for the Department of Homeland Security to change its rules so that EDLs can be created that do not need to contain what it characterizes as “facilitative technology”; and be it further

A bill to amend 1951 PA 51, entitled “An act to provide for the classification of all public roads, streets, and highways in this state, and for the revision of that classification and for additions to and deletions from each classification; to set up and establish the Michigan transportation fund; to provide for the deposits in the Michigan transportation fund of specific taxes on motor vehicles and motor vehicle fuels; to provide for the allocation of funds from the Michigan transportation fund and the use and administration of the fund for transportation purposes; to set up and establish the truck safety fund; to provide for the allocation of funds from the truck safety fund and administration of the fund for truck safety purposes; to set up and establish the Michigan truck safety commission; to establish certain standards for road contracts for certain businesses; to provide for the continuing review of transportation needs within the state; to authorize the state transportation commission, counties, cities, and villages to borrow money, issue bonds, and make pledges of funds for transportation purposes; to authorize counties to advance funds for the payment of deficiencies necessary for the payment of bonds issued under this act; to provide for the limitations, payment, retirement, and security of the bonds and pledges; to provide for appropriations and tax levies by counties and townships for county roads; to authorize contributions by townships for county roads; to provide for the establishment and administration of the state trunk line fund, local bridge fund, comprehensive transportation fund, and certain other funds; to provide for the deposits in the state trunk line fund, critical bridge fund, comprehensive transportation fund, and certain other funds of money raised by specific taxes and fees; to provide for definitions of public transportation functions and criteria; to define the purposes for which Michigan transportation funds may be allocated; to provide for Michigan transportation fund grants; to provide for review and approval of transportation programs; to provide for submission of annual legislative requests and reports; to provide for the establishment and functions of certain advisory entities; to provide for conditions for grants; to provide for the issuance of bonds and notes for transportation purposes; to provide for the powers and duties of certain state and local agencies and officials; to provide for the making of loans for transportation purposes by the state transportation department and for the receipt and repayment by local units and agencies of those loans from certain specified sources; and to repeal acts and parts of acts,” by amending section 10 (MCL 247.660), as amended by 2007 PA 210.
