O Creator and Author of life, the Sustainer of hope, be present with us gathered here this morning. At the beginning of a new session this day, we ask for Your blessing and presence in our midst as we have gathered in this hallowed place of honor and trust. Grant that a spirit of reason and goodwill will permeate the thinking of these state Senators and their endeavors throughout this day as they deliberate the issues of life for the people of our great state. Grant that they might heed the urgings of a higher power as each of us might demonstrate that wisdom within our lives. Grant Your blessing upon us in this hour, O God, that we may surely perform all that has been entrusted to us to contribute to the good of others. Free us from the constraints of routine and the trivial so that we may experience the greater blessings beyond.

We pray these things in the unity of a faith that is confident in the Lord of peace and hope. Amen.

A concurrent resolution of tribute offered as a memorial for President Ronald Reagan.

Whereas, With the passing of Ronald Reagan, the 40th President of the United States, our nation unites to salute the memory of a beloved leader and celebrate the life of a gentleman who truly embodied the best of the American spirit. With his boundless optimism and clarity of purpose, President Reagan left his mark on history as a leader of unwavering principle and unshakable belief in the noble ideals of our country; and

Whereas, Born and raised amid humble surroundings in Illinois, Ronald Reagan took an unusual career path to the White House. His innate gift for communicating with people--which was to serve him so well in the nation's highest office--helped to forge convictions on personal responsibility and initiative that shaped his philosophy of what the role of government should and should not be. Two terms as the Governor of California illustrated his determination and vision in incorporating his convictions into public policies for the greater good; and

Whereas, His nomination for the presidency at the 1980 Republican National Convention in Detroit set in motion a new way of approaching the nation's challenges. He took office at a dark hour in our history, with runaway inflation, unemployment rates at the highest levels since the Great Depression, and grave threats from overseas. Through comprehensive reforms, new attitudes, and the magnetism of his personality, Ronald Reagan left office with the country in far stronger shape; and

Whereas, Most of all, President Reagan's contagious optimism gave heart to our country and strengthened America's devotion to the highest ideals of self-government. Where others saw despair, he saw hope. Where others saw problems, he saw opportunity. The collapse of communism in the Soviet Union, the end of the Cold War, and an invigorated commitment to liberty are lasting legacies of the man who reminded us, in both his words and his deeds, of our country's greatness and its responsibilities. Increases in rates of compensation authorized by the commission may be effective only at the start of a fiscal year and shall require prior notice to the governor, who shall transmit such increases to the legislature as part of his budget. The legislature may, by a majority vote of the members elected to and serving in each house, waive the notice and permit increases in rates of compensation to be effective at a time other than the start of a fiscal year.

Whereas, As a result of recently completed negotiations, a settlement has been reached on a three-year contract between the state and the Michigan State Police Troopers Association regarding compensation and other terms and conditions of employment. This settlement, which will be retroactive to its effective date of October 1, 2002, was reached past the time when the governor could transmit the increase as part of the budget; and

Whereas, The acting State Personnel Director, with the consent of the Chair of the Civil Service Commission, granted interim approval of the collective bargaining agreement on May 18, 2004; now, therefore, be it

Whereas, The Department of Corrections has requested authorization to spend in excess of $600,000.00 from existing operational accounts for the purpose of expediting capital renovations at Huron Valley Correctional Facility and Huron Valley Center that will facilitate the relocation of inmate populations and allow for the subsequent closure of Western Wayne Correctional Facility; and

Whereas, The Department of Corrections has estimated that the total cost of these renovations is $3,000,000.00; and

Whereas, The Department of Corrections must commence these projects immediately in order to ensure renovations are completed by October 1, 2004, to accommodate the relocation of female inmates from Western Wayne Correctional Facility to the Huron Valley Center, and the corresponding transfer of prisoners under psychiatric care from the Huron Valley Center to Huron Valley Correctional Facility; and

Last Thursday I was absent from these chambers because I was in Washington, D.C., to pay my respects to the former President, and also I had some other duties to fulfill. As a result, I missed a number of votes last Thursday. Specifically, Senate Bill No.151, I would have voted "yes" for that; Senate Bill No.241, calendar item No.26, I would have voted "yes" as well; House Bill No.4983, calendar item No.28, I would have also concurred with that and voted for that; and finally, House Bill No.5859, item No.37, I would have voted for that item as well.

Senator Scott's statement is as follows:

Last Thursday I listened to testimony from the state insurance commissioner during the Senate Banking and Financial Institutions Committee hearing. There was some good dialogue between the commissioner and her staff and members of the committee. Specifically, the practice of using credit scores was addressed and whether this system unfairly penalizes the poor and others who may not have good credit, but there are some poor who do have good credit. This hearing was a good starting point as we work to bring relief to thousands of Michigan citizens who are continuing to see their insurance rates climb with no relief in sight. It is through these meetings and through positive, productive discussions that we can work together to bring meaningful results.

Based on findings from extensive research, our state insurance commissioner approximated that rates could drop by as much as 10-45 percent if credit scoring was banned. What we would see is a reduction in our overall base rate, which is the amount of our premiums before any discounts. Given the amount of error that can occur in current reports and through the credit scoring practice, this ban would most assuredly bring fairness and equity back to the rate-setting process.

I am happy to report that the Office of Financial and Insurance Services will hold four public hearings across the state on our Governor's proposal to ban credit scoring in setting auto and home insurance rates. These hearings will allow the public to provide necessary and valuable input on the issue. The hearings will take place next month in Lansing, Grand Rapids, Detroit, and Flint. I urge you to notify your constituents about these important hearings.

But I am still concerned about certain zip codes in urban areas that end up subsidizing others in suburban areas. Just yesterday I spoke to a developer who was in my city. We talked about some new cars. He has three new cars that he pays the same rate as I pay for my one car. So I would hope that we would not only deal with credit scoring, but also with certain zip codes in urban areas, and I think it's time for us to deal with that now. We have been talking about this too long, and last year we had hearings around the state that proved that there are certain suburban areas that are paying these high costs, but yet we are doing nothing about it. Now it is time for us to do something about this.
